TERMS OF SERVICE AND EULA

1. Introduction
These Terms of Service ("Terms") govern your use of the Sagostund application (the "App"). By downloading or using the App, you agree to these Terms. This Agreement is between you and Random Glitch AB ("we," "us," or "Company"), and not with Apple Inc. or Google LLC.
You must be at least 18 years old to enter into these Terms. If you are under 18, you may use the App only with the consent and supervision of a parent or legal guardian.
2. Scope of License
Random Glitch AB grants you a limited, non-exclusive, non-transferable, revocable license to use Sagostund for your personal, non-commercial purposes on any device that you own or control. We reserve all other rights not explicitly granted.
3. Subscriptions and Pricing
- Pricing: The specific price for your subscription is displayed clearly in the app before you confirm your purchase. Prices may vary by region, currency, and local taxes.
- Billing: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Auto-Renewal: Your subscription automatically renews unless you turn off auto-renew at least 24 hours before the current period ends.
- Cancellation (iOS): Go to your Settings App > Apple ID > Subscriptions.
- Cancellation (Android): Go to Google Play Store > Menu > Subscriptions.
- EU Right of Withdrawal: If you are a consumer based in the EU, you normally have the right to withdraw from a contract within 14 days. However, by downloading the App or subscribing, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal once the digital content is delivered or the subscription service has commenced.
- Price Changes: We reserve the right to adjust pricing for our service in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following appropriate notice to you.
4. User Conduct
By using Sagostund, you agree to the following rules:
- No Abuse: You will not use the App to harass, abuse, threaten, or impersonate any person or entity.
- No Objectionable Content: You will not post or transmit content that is offensive, pornographic, hateful, or violates any law.
- Zero Tolerance: Random Glitch AB has a zero-tolerance policy for objectionable content and abusive behavior. We reserve the right to monitor user content and will immediately ban users found violating these standards.
- Intellectual Property: You will not reverse engineer, copy, or attempt to derive the source code of the App.
5. Third-Party Agreements
You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).
6. Legal Compliance
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Disclaimers and Warranties
- "As Is": The app is provided "as is" without warranties of any kind.
- Apple’s Role: If the app fails to work as promised, iOS users can notify Apple for a refund of the purchase price. Beyond that, Apple has no other warranty obligation.
- Maintenance: Random Glitch AB is solely responsible for providing any maintenance and support services. Apple and Google have no obligation to provide support.
8. Liability and Claims
Random Glitch AB, not Apple or Google, is responsible for addressing any claims relating to the App, including but not limited to:
- Product liability claims.
- Claims that the App fails to conform to any applicable legal or regulatory requirement.
- Claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App infringes that third party’s intellectual property rights, Random Glitch AB, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Random Glitch AB be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall our total liability to you for all damages exceed the amount of fifty U.S. dollars ($50.00) or the equivalent in local currency.
9. Third-Party Beneficiary
You and Random Glitch AB acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your data. By using the App, you consent to our data practices as described in our Privacy Policy.
11. Governing Law
These Terms are governed by the laws of Sweden, excluding its conflicts of law rules.
If a dispute arises that we cannot resolve directly, you may have the right to submit your complaint to the National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN). You can contact ARN via their website at www.arn.se.
